EQUIPMENT RENTAL AGREEMENT & LIABILITY WAIVER

This Equipment Rental Agreement & Liability Waiver (the "Agreement") is entered into by and between Wild Adventure Rentals LLC ("Company") and the individual or entity renting equipment ("Renter"). By checking the box or signing this Agreement, the Renter acknowledges and agrees to the following terms and conditions:

1. ASSUMPTION OF RISK

Renter understands and acknowledges that the use of rented equipment, including but not limited to e-bikes, canoes, hybrid bikes, lily pads, stand-up paddleboards, and inflatable dock platforms, involves inherent risks, including but not limited to accidents, falls, collisions, equipment malfunctions, drowning, and other hazards that may result in serious injury, disability, or death. Renter voluntarily assumes all risks associated with the use of the rented equipment.

2. RELEASE OF LIABILITY & WAIVER OF CLAIMS

Renter, on behalf of themselves, their heirs, executors, administrators, assigns, and representatives, hereby releases, waives, discharges, and covenants not to sue Wild Adventure Rentals LLC, its owners, employees, agents, affiliates, and successors ("Released Parties") for any and all claims, liabilities, demands, actions, or causes of action arising from or related to Renter’s use of the rented equipment, including but not limited to personal injury, property damage, or wrongful death, whether caused by negligence or otherwise.

3. INDEMNIFICATION

Renter agrees to indemnify, defend, and hold harmless the Released Parties from any and all liabilities, claims, demands, damages, costs, and expenses (including attorney fees) arising from or related to Renter’s use of the rented equipment, including any claims made by third parties.

4. EQUIPMENT RESPONSIBILITY & DAMAGE FEES

Renter assumes full responsibility for the rented equipment from the time of pickup until the time of return. Renter agrees to:

Use the equipment only for its intended purpose and in a lawful manner.
Return the equipment in the same condition as received, normal wear and tear excepted.
Be responsible for any loss, theft, damage, or destruction of the equipment.
Pay the full cost of repair or replacement for damaged, lost, or stolen equipment, as determined by the Company.
A security deposit may be required, and Renter authorizes the Company to charge their payment method for any damages or losses incurred.

5. PAYMENT, REFUNDS & CANCELLATION POLICY

Full payment is required at the time of booking.

Refunds will be issued per the Company’s cancellation policy.
Late returns may incur additional fees at the discretion of the Company.

6. SAFETY ACKNOWLEDGMENT

Safety is our TOP PRIORITY! Renter agrees to:

Watch all applicable training videos prior to using the rented equipment and acknowledges they feel comfortable and safe operating the equipment.
Contact Wild Adventure Rentals LLC directly with any safety-related questions or concerns.
Request additional training or certification information prior to use, if needed.
Remain vigilant and monitor changing weather conditions, which can shift quickly in the Lake Superior and northern Wisconsin region.
Check current and forecasted weather conditions using NOAA.gov or your preferred reliable weather app.
Immediately cease use and return to shore or safety if weather changes pose a potential risk (e.g., high winds, lightning, or sudden temperature drops).

7. PROHIBITED USES

Renter agrees NOT to:

Use the equipment while under the influence of drugs or alcohol.
Sublease or allow unauthorized persons to use the equipment.
Engage in reckless or negligent behavior that endangers themselves or others.
Use the equipment in hazardous conditions, including Lake Superior (for canoes or other watercraft), rough waters, or storms.

⚠️ Important Disclaimer:
Canoes rented from Wild Adventure Rentals LLC are only permitted on inland lakes. Use on Lake Superior is strictly prohibited, as it requires specialized training, rescue planning, and advanced water navigation skills. Renter agrees not to use any Wild Adventure Rentals canoe or paddle equipment on Lake Superior under any circumstances.

8. EQUIPMENT AVAILABILITY & RENTAL CONDITIONS

Rental inventory may vary from images shown online. However, the equipment provided will be of equal quality and functionality.

9. GOVERNING LAW & SEVERABILITY

This Agreement shall be governed by the laws of the State of Wisconsin. If any part of this Agreement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

10. GPS TRACKING DISCLOSURE

For security and theft prevention purposes, certain rental equipment, such as e-bikes, may be equipped with discreet GPS tracking devices (e.g., Apple AirTags). These devices are used solely to help locate and recover equipment in the event it is lost, stolen, or not returned. Location data is not actively monitored during the rental period and will be deleted within 14 days of return. By accepting this Agreement, the Renter acknowledges and consents to the use of such tracking technology during the rental period.

11. PHOTO ID REQUIREMENT

Renter agrees to present a valid government-issued photo ID at time of pickup for verification and liability purposes.

12. ACKNOWLEDGMENT & AGREEMENT

By checking the box or signing below, Renter acknowledges that they:

Have read and understood this Agreement.
Have watched the appropriate training videos and feel safe using the rented equipment.
Accept these terms voluntarily and agree to assume full responsibility for all associated risks.
Understand that Wild Adventure Rentals LLC is available for questions or concerns at any time, and safety is always our #1 priority.
